FROM THE LEGISLATIVE BENCH

From The Legislative Bench... Remember the ole saying, “Know thy enemy”? It is derived from The Art of War by Sun Tzu... “If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not your enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Well, here is a glimpse of the enemy and their position of support (excerpt) for the “bill to improve NICS...” HR 2640 passed in the House and is in the Senate for consideration.

U.S. Senate Must Pass Bill to Strengthen Brady Background Checks
House-passed bill to improve National Instant Check System on hold in Senate

EMAIL YOUR
U.S. SENATORS TODAY

Urge Them to Strengthen Brady Background Checks

Earlier this week, our allies in the U.S. Senate tried to move a bill to the Senate floor for a vote that would strengthen the Brady background check system and make it harder for criminals and other dangerous people to buy firearms.

But one Senator, Tom Coburn (R-OK), blocked consideration of the bill and this critical measure remains "on hold" in the Senate.

A similar bill was passed by the House in June, and now we need the Senate to act! Please email your Senators today and tell them to pass the National Instant Check System (NICS) Improvement Act and strengthen Brady background checks.

The problem is that many states fail to supply thousands and thousands of records of prohibited gun buyers to the national Brady background check system. That means many felons, domestic violence abusers, and those who are dangerously mentally ill can walk into a gun store and buy weapons without being stopped.

The Virginia Tech massacre is a horrific example of the dangers of this data gap. The killer was able to buy guns even though he was legally prohibited from doing so, because the records indicating that he had been adjudicated mentally ill and dangerous were not in NICS when his background checks were conducted.

Another tragedy like Virginia Tech could happen tomorrow. We must act now to keep guns out of the hands of dangerous people. Please send your email today.

Sincerely,

I omitted the pleas for donations to Brady and the links to contact Senators to urge their compliance with Brady’s position.

You are aware of the support from the NRA regarding this very piece of proposed legislation and the opposition from such groups as GOA and GRNC... a kink in the firearms’ community armor. As I have stated previously, I feel the wording needs much improvement... leaves too much to subjectivity. Such legislation is dangerous to our well being and that of the Second Amendment when all is not precise. We can not afford to have sections of this bill vague in its treatment of critical wording such as “DETERMINATION” and “OTHER LEGAL AUTHORITY”... too much leeway.

In the “American Rifleman” magazine, the NRA addressed many of the concerns from the firearms community regarding their (OUR!) stance... not enough for me. The legislation should be nailed down so there is no question of what was intended versus what becomes law!

On guard,

Ron

BUCCANEER RANGE REGULATOR GAZETTE

 Regulator Gazette

September 1897

Headline: Lawyer Slowhand Learns About the Three Kick Rule

Crooked lawyer from back east Slowhand went duck hunting in rural Regulatorville. He shot and dropped a bird, but it fell into Dick Hollidays field on the other side of a fence.  As Slowhand climbed over the fence, Holliday rode up on his trusty steed "Big Johnson" and asked him what he was doing.

Slowhand responded, "I shot a duck and it fell in this field, and now I'm going to retrieve it."

Dick replied, "This is my property, and you are not coming over here."

The indignant lawyer said, "I am one of the best trial attorneys in the United States and, if you don't let me get that duck, I'll sue you and take everything you own."

Dick smiled and said, "Apparently, you don't know how we settle disputes in Regulatorville. We settle small disagreements like this; with the 'Three Kick Rule.'"

The lawyer asked, "What is the 'Three Kick Rule'?"

Dick replied, "Well, because the dispute occurs on my land, I get to go first. I kick you three times and then you kick me three times and so on back and forth until someone gives up."

The attorney quickly thought about the proposed contest and decided that he could easily take the old codger. He agreed to abide by the local custom.

Dick slowly climbed down from "Big Johnson" and walked up to the attorney.

His first kick planted the toe of his heavy steel toed work boot into the lawyer's groin and dropped him to his knees.

His second kick to the midriff sent the lawyer's last meal gushin’ from his mouth.

The lawyer was on all fours when the farmer's third kick to his rear end, sent him face first into a fresh cow pile.

The lawyer summoned every bit of his will and managed to get to his feet.

Wiping his face with the arm of his jacket, he said, "O'kay, you old bastard. Now it's my turn."

Dick smiled and said, "Nah, I give up. You can have the duck."
